Terms and Conditions - Shankeshwar Sparsh

1. Booking and Payment

A booking amount must be paid to reserve a unit in the Shankeshwar Sparsh project. This amount is non-refundable. Subsequent payments must be made as per the payment schedule provided at the time of booking. Failure to make payments on time may result in the cancellation of the booking, and the developer reserves the right to levy penalties for delayed payments.

2. Modification of Plans

The developer reserves the right to make minor changes or modifications to the design, layout, specifications, amenities, and plans as may be required to ensure the overall development of the project or as directed by relevant authorities. Such changes will be made without altering the overall quality or standard of the project, and buyers will be informed of any significant modifications.

3. Possession and Handover

Possession of the property will be handed over to the buyer upon full payment and compliance with all terms and conditions outlined in the sale agreement. Any delays in possession due to unforeseen circumstances, including but not limited to force majeure events, regulatory approvals, or other uncontrollable factors, will not be the responsibility of the developer.

4. Transfer and Resale

Buyers are allowed to transfer or resell their units only after obtaining the necessary clearance and consent from the developer and completing all required documentation. Transfer or resale will be subject to applicable fees, taxes, and charges as per government regulations.

5. Maintenance and Charges

Upon possession, buyers are required to pay maintenance charges for the upkeep and maintenance of common areas and facilities. The maintenance charges will be determined by the developer or the property management company and will be subject to periodic revisions.

6. Compliance with Rules

Residents occupants must comply with the rules and regulations set forth by the developer, property management, or housing society for the peaceful and harmonious living of all residents. Any violation of rules, nuisance, or illegal activity may result in fines, penalties, or legal action as deemed necessary by the developer or managing authorities.

7. Dispute Resolution

Any disputes or differences arising out of or relating to the terms and conditions of the sale agreement will be resolved amicably through mutual discussions. In case of failure to resolve the dispute amicably, it will be subject to arbitration under the Arbitration and Conciliation Act, 1996, or any statutory modification thereof.

8. Legal Compliance

The sale and purchase of units in Shankeshwar Sparsh will comply with all applicable laws, regulations, and governmental orders. Buyers are required to adhere to all legal and regulatory requirements as stipulated by local authorities.

9. Disclaimer

10. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the jurisdiction of the courts in Pune, Maharashtra.
